Court Rules that the HRBRRD can Bill Downstream Counties for Flood Control – May 11, 2012

A state Supreme Court Appellate panel ruled on May 10, 2012 that the Hudson River Black River Regulating District (HRBRRD) was justified in billing the downstream counties of Warren, Washington, Saratoga, Albany and Rennselaer for flood control.  However, the Court ruled that in determining the total flood control bill the HRBRRD must first subtract the flood control benefit received by the State for it’s downstream property and infrastructure.
